1                     When does this Privacy Statement for Job Applicants apply?

In relation to our recruiting of personnel, we process personal data of (potential) job applicants. This includes all persons that show interest in, apply to or are considered for any of the positions as employee at Yamaha. This Privacy Statement also applies specifically to our processing of personal data in relation to your visit and use of our jobs website. If your application leads to the conclusion of an employment agreement with us, our internal privacy statement(s) on the processing of personal data of, amongst others, our employees will apply to our subsequent processing of personal data.

2                     Who is responsible for the processing of your personal data?

Yamaha Motor Europe N.V., our European headquarters located in Amsterdam and its branches located in other countries, is the data controller responsible for the processing of your personal data, together with any other of your potential Yamaha employer(s). We may share your personal data with our branches and affiliates depending on the job you are applying for and the country location of the job opening.

We may also obtain your personal data from or share your personal data with recruitment agencies. Such recruitment agencies will also be data controllers responsible for the processing of your personal data, jointly with us for the sharing of your personal data between us and the recruitment agency. We are not responsible for the collection of personal data by recruitment agencies and their independent processing of personal data in relation to their independent database of job seekers.

3                     What personal data do we process about you?

When you apply for a job with us, we may process the following personal data of you:

· Personal details: your full name and title(s).

· Address and contact details: address, email address, (mobile) phone number.

· Demographic information: Age, gender, date of birth, place of birth, nationality, language(s).

· Photo(s).

· Work permit (citizenship and immigration status).

· Information on your career: previous employers and jobs, current employer, function and grade.

· Education, training and qualifications: academic studies, professional experience and qualifications, certificates, professional membership, publications and licenses.

· Information on current compensation/employment conditions: salary, commissions, bonus, benefits, taxes and pension retributions.

· Information on reimbursements of expenses you made in the application process, if approved by us.

· Other information included on your resume and letter of application.

· Position(s) you are interested in.

· Information on whether you have a Certificate of Good Conduct.

4                     Why do we process this personal data and what are the applicable legal grounds?

 

We will process your personal data for the following purposes, based on the following legal grounds listed in relation to each specific purpose:

Recruitment and selection of (potential) personnel, including ensuring a fair and consistent recruitment procedure for all applicants and analysing, reporting and evaluating the effectiveness of our recruitment process.

Your consent. In some situations, we will only process your personal data if you have provided us with your consent. This may, for example, be the case if we have decided not to conclude an employment agreement with you, but requested your consent to retain your information for one year instead of our usual retention term of four weeks after completing your job application process. We may request such consent, for example, to be able to consider and contact you for a different job opening after completion of your application.

 

You may of course withhold your consent, which will not have any detriment to the assessment of your application. You may also withdraw your consent at any time by sending us an email (see our contact details below). We will then erase your personal data insofar the processing thereof is based on your consent. If you withdraw your consent, such withdrawal will not affect the lawfulness of our processing of your personal data before your withdrawal of your consent.

 

Performance of a contract. In case you apply for a position with us, and we have decided to enter into an employment contract with you, we will process your personal data based on such contract, including insofar as necessary to enter into such contract.

 

Legitimate interest. Your personal data will also be processed based on our legitimate interests. Our legitimate interests include maintaining and improving the efficiency, fairness, consistency and correctness of our recruitment process.

5                     How did we obtain your information?


In general, we obtain your personal data directly from you. We may also obtain your personal data through social media, to the extent permitted by the applicable law. Additionally, we may obtain your personal data through recruitment agencies that introduce you to us or via referees, indicated by you.

In the context of the recruitment of personnel, no form of automated decision making - including profiling - is used by us.

7                     How long do we retain your information?

 

In general, personal data of job applicants will be retained for no longer than is necessary for the purpose of the processing, which means that your personal data will not be retained longer than 4 weeks after completion of the application procedure, unless:

·         You are subsequently employed by Yamaha;

·         You have provided your consent to us for retaining your personal data up to one year after completion of the application procedure, if you have not been employed by Yamaha upon completion of your application procedure.

·         We need to process your personal data for handling disputes or other legal matters, or

·         We need to process your personal data to comply with a legal requirement.

 

8                     Who will have access to your personal data?

In addition to authorized personnel of Yamaha, we may share your personal data with the parties mentioned below in the context of recruitment of personnel.

·            Service providers. For the recruitment of personnel, we have engaged service providers, including HROffice (provided by Adver-Online B.V.). In addition to this, we may share your personal data with other service providers, such as a hosting provider for our website(s).

 

·            Public authorities. If required by law, a judicial decision, or other decision of a competent public authority, we will share your personal data in line with such obligation for as far as necessary.

 

When we use services of a party who processes your personal data on our behalf, acting as a data processor, we have concluded appropriate data processor agreements in line with applicable data protection laws. We also made appropriate arrangements with service providers acting as joint data controller for the processing of your personal data.

9                     How do we transfer your personal data outside the EEA?

The processing of your personal data in the context of recruitment of personnel may entail the transfer of your personal data to Yamaha branches and affiliates, and selected third parties. The Yamaha branches and affiliates, and selected third parties may be located outside of the Economic European Area (EEA). Where applicable, we rely on an adequacy decision of the European Commission for the transfer of personal data to a non-EEA country or have taken appropriate safeguards to transfer your personal data to a country located outside the EEA, if that country does not provide an adequate level of protection according to the applicable data protection laws, including standard contractual clauses approved by the European Commission. 10                  How do we protect your personal data?
